Welcome to Thuma Mina Pay. These terms and conditions outline the rules and regulations for the use of Thuma Mina Pay's WhatsApp-based payment service (the "Service"), a product of Mdiga Dynamics.

By accessing or using our Service, you accept these terms and conditions in full. Do not continue to use Thuma Mina Pay's Service if you do not accept all of the terms and conditions stated on this page.

1. The Service

Thuma Mina Pay provides a technology platform that enables users to pay for third-party services ("Clients") using OTT Vouchers via WhatsApp. We act as a facilitator and are not a party to the transaction between you and the Client. We do not hold, process, or transmit any funds. Your payment is made directly from OTT Payments (Pty) Ltd to the Client's designated merchant account.

2. User Obligations

By using the Service, you agree to:

  • Provide accurate and complete information, including your Client account number and a valid, unused OTT Voucher PIN.
  • Ensure you have purchased an OTT Voucher for the correct amount as specified by our Service. We are not responsible for overpayments or underpayments.
  • Use the Service only for lawful purposes and not for any fraudulent or illegal activities.
  • Be the legitimate owner of the WhatsApp account and the OTT Voucher you are using.

3. Fees

Thuma Mina Pay charges a flat, non-refundable service fee of R20 (Twenty Rand) for each successful transaction, regardless of the payment amount. This fee is clearly communicated to you before you provide the OTT Voucher PIN. The total amount of the OTT Voucher you are instructed to buy includes both the amount due to the Client and our R20 service fee. There are no hidden charges, percentage-based fees, or variable costs — you always know exactly what you are paying.

4. Payments and Refunds

All transactions are final. Once an OTT Voucher has been successfully redeemed, the payment cannot be reversed or refunded by Thuma Mina Pay. Any disputes regarding the payment, the amount paid, or the service received from the Client must be resolved directly with the Client.

If an OTT Voucher PIN is invalid, expired, or has already been used, the transaction will fail, and we will notify you. No service fee is charged for failed transactions.

5. Limitation of Liability

Thuma Mina Pay is a technology provider. We are not responsible for:

  • Any service interruptions or failures of the WhatsApp platform or the OTT Payments API.
  • The quality, delivery, or any other aspect of the services provided by our Clients.
  • Any losses incurred due to you providing incorrect information (e.g., a wrong account number).
  • Any losses incurred if your WhatsApp account or OTT Voucher PIN is compromised or used without your authorisation.

To the fullest extent permitted by law, Mdiga Dynamics and Thuma Mina Pay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service.

6. Intellectual Property

The Thuma Mina Pay name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Mdiga Dynamics or its affiliates or licensors. You must not use such marks without the prior written permission of Mdiga Dynamics.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by this reference. Please review our Privacy Policy to understand our practices regarding your personal information.

8. Termination

We reserve the right to suspend or terminate your access to our Service at any time, without notice, for any reason, including but not limited to a breach of these Terms and Conditions or engaging in any fraudulent or illegal activity.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
